Our total liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Sonic Bloom Studios for the Services during the term of the agreement.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree that any legal action or proceeding between you and Sonic Bloom Studios for any purpose concerning these Terms or the Services shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Austin, Texas.

These terms are effective as of January 1, 2025.

Recording Session Specific Terms

In addition to the above terms and conditions, the following terms apply specifically to booking and conducting recording sessions at Sonic Bloom Studios:

Session Booking and Cancellation:

Session times must be booked in advance with a minimum of 24 hours notice.
A deposit of 50% of the total session cost is required to secure your booking. This deposit is non-refundable if you cancel within 48 hours of the scheduled session time.
Cancellations made more than 48 hours prior to the session will receive a full refund of the deposit.
Sonic Bloom Studios reserves the right to cancel or reschedule a session due to unforeseen circumstances, such as equipment malfunction or staff illness. In such cases, a full refund will be provided, or the session can be rescheduled at your convenience.

Session Conduct:

Clients are expected to arrive on time for their scheduled session. Late arrivals may result in a shortened session, with no reduction in the agreed-upon fee.
Clients are responsible for their own belongings. Sonic Bloom Studios is not liable for any loss or damage to personal property.
Clients are expected to conduct themselves in a professional and respectful manner. Any disruptive or inappropriate behavior may result in the immediate termination of the session, with no refund.
No outside food or beverages are allowed in the studio without prior approval from Sonic Bloom Studios.
Smoking is strictly prohibited inside the studio premises.

Payment and Usage Rights:

Full payment for the session is due upon completion of the session.
Sonic Bloom Studios retains ownership of all master recordings until full payment has been received.
Upon receipt of full payment, clients are granted a license to use the master recordings for commercial and non-commercial purposes, subject to any agreements made with other involved parties (e.g., musicians, songwriters).
Sonic Bloom Studios reserves the right to use excerpts of recordings for promotional purposes, unless otherwise agreed upon in writing with the client.

Data Storage and Archiving:

Sonic Bloom Studios will maintain backups of your session data for a period of 30 days after the session date.
It is the client's responsibility to create and maintain their own backups of the session data after this period. Sonic Bloom Studios is not liable for any loss of data after the 30-day period.
Long-term archiving services are available for an additional fee. Please contact Sonic Bloom Studios for details.

Equipment Usage and Liability:

Clients are permitted to use the studio's equipment under the supervision of a Sonic Bloom Studios engineer.
Clients are responsible for any damage to the studio's equipment caused by their negligence or misuse. The client will be liable for the cost of repair or replacement.
Clients are encouraged to bring their own instruments and equipment. Sonic Bloom Studios is not responsible for any damage or loss to client-owned equipment.
